The Kafala/Sponsorship System
Kuwait along with all other GCC (Gulf Cooperation Council) countries offers sponsorship or a “Kafala” system. The Kafala system makes the employer or the company the Kafeel of the employee.
This system gives the employer or the company the complete legal and financial responsibility of the employee. The employer obtains and provides the work permit, residence permit, and NOC to the employee.
Thus, the legal status of the employee depends on the employer, and without the employer’s permission, the employee cannot enter or leave the country.
The private sector is governed by the country’s labor law. If the employee is working in the private sector, they are entitled to receive rights provided by the labor law of Kuwait.
In terms of work, the employee is protected by what is mentioned in the work contract between the employer and the employee.
The contract is enforced by the civil law of the country. Thus, the employee can file a lawsuit against the company or vice versa if it goes against the contract in any way.
